Who we are

49 - Focus Booster ("49") is made by Artur Pereć in Poland, who is responsible for your data under the EU General Data Protection Regulation (GDPR). You can reach us at contact49game@icloud.com.

Your games, on your iPhone and in your iCloud

Your games, scores, statistics, achievements and settings are stored on your iPhone. If you are signed in to iCloud, your games, achievements and streak freezes are also copied to your own private iCloud storage, so they come back on a new iPhone or after you reinstall the app. Apple keeps that copy in your iCloud account, and we can't see it. Your settings, look and purchases are not part of it. There is no account to create, and your game history is not sent to us.

Deleting the app deletes the data on your iPhone. To delete the iCloud copy, open your iPhone's Settings → your name → iCloud → Manage Storage → 49, and delete its data. The copy exists to give you the feature you use, so we rely on Article 6(1)(b) GDPR (performance of a contract).

Multiplayer

Multiplayer runs on Apple's iCloud, in a public database that every copy of 49 shares. When you open Multiplayer, 49 creates a player profile there with your nickname, your Game Center photo if you have one, your multiplayer ratings, your record and your recent games (when, which game, your place, your opponents and how your rating changed). When you play in a room or a game of Steal, the room's settings, its name if it has one, every player's nickname and each round's results (times, points, mistakes and splits) are stored there too. So are friend requests, accepted requests and invites to games. A room's password is never stored: only a scrambled value (a hash) made from it and the room's code, which can check a password but not reveal it. Rooms made with versions of 49 before 1.0 (21) stored the password itself.

Other players of 49 can see your nickname, photo, ratings and recent games, and the players in your rooms see your results. Choose a nickname you're happy for others to see. We can see this data as well, and we use it only to run multiplayer. Your profile is linked to your Game Center player ID (an identifier Apple makes for each game) when you are signed in to Game Center, otherwise to a random ID made on your iPhone. It is not linked to your name, email address or Apple Account. To host or join a room you need to be signed in to iCloud. Games in guest mode are never stored there.

When a room closes, your entries in it are removed. Your profile and friend messages stay so that your ratings and friends keep working, until you delete them. To delete them, open Multiplayer, tap your profile and tap Delete my multiplayer profile (in version 1.0 (21) and later). That removes from iCloud your profile and photo, the friend requests and invites you sent and your entries in rooms, and removes your name from the rooms you hosted. On your iPhone it clears your nickname, friends and room history. iCloud only lets the player who created a record delete it, so messages other players sent you, and your nickname in other players' recent games, stay until you email us and we remove them. You can also email us to delete everything at once. You can play every other part of 49 without opening Multiplayer. We rely on Article 6(1)(b) GDPR (performance of a contract), because this is the feature you choose to use.

Anonymous usage statistics

To understand how 49 is played and make it better, the app sends anonymous usage statistics to TelemetryDeck, an analytics service based in Germany. For example: that a game was finished, with its mode, board, time, mistakes and hints, which screens are opened, how far new players get through the welcome steps, and which features (such as the Daily Challenge, hints or multiplayer) are used. Each event carries an anonymous identifier that is hashed on your iPhone before it is sent, so it can't be linked to you, your name, your Apple Account or your device's advertising identifier. Nothing is used for advertising or shared with others.

We rely on our legitimate interest in improving the game (Article 6(1)(f) GDPR). You can turn this off at any time in the app's Settings under "Share anonymous statistics". See TelemetryDeck's privacy policy.

Waiting list

If you join the waiting list on this website, your email address and the language of the page you signed up on are sent through Web3Forms, a form service, to our support inbox (contact49game@icloud.com, hosted by Apple's iCloud Mail). We use them only to send you an invite to the TestFlight beta and news about the launch of 49, we never share them, and we delete them when you ask. We rely on your consent (Article 6(1)(a) GDPR), which you can withdraw at any time by emailing us. See Web3Forms' privacy policy.

Game Center (optional)

If you sign in to Game Center, your scores and achievements are sent to Apple to show leaderboards. 49 also reads the leaderboards to tell you when someone takes your top 3 place, and uses your Game Center name, photo and player ID for multiplayer, as described above. Apple handles Game Center data under its own privacy policy. You can play without Game Center.

Purchases

Premium is sold through the App Store. Apple processes your payment, and we never see your payment details. The app only receives confirmation of what you've bought, so it can turn Premium on.

Advertising

The free version shows ads between games, provided by Google AdMob. To show and measure ads, AdMob may collect device identifiers, your approximate location (from your IP address) and information about how you interact with ads. In the EU, the EEA and the UK you are asked for your consent first, and you can change your choice at any time in the app's Settings. 49 never asks to track you across other apps and websites, so Google can't use your device's advertising identifier and the ads aren't personalized to you. See Google's privacy policy.

Premium removes all ads, and with them this data collection.

Notifications

The streak and Daily reminders, the alert when someone takes your top 3 place on a leaderboard and the alert when quick pairing finds you a game are all scheduled on your iPhone itself. Nothing is sent to us. 49 may also ask iCloud to let your iPhone know about new friend requests and invites.

Problem reports

After a crash, or when you tap Report a problem in Settings, 49 offers to email us the diagnostics your iPhone saved: the app and iOS versions, your iPhone model and technical details of the crash or hang. Nothing is sent unless you choose to send it. If you allow sharing analytics with app developers in your iPhone's settings, Apple may also share crash reports with us.

Children

49 is not directed at children under 13 and does not knowingly collect their personal data.

Support

If you contact us, we use your message to help you and keep the conversation only as long as it is useful for that.

This website

This website is hosted on GitHub Pages. GitHub may log technical data such as your IP address to keep the service secure, as described in the GitHub privacy statement. The website sets no cookies, uses no analytics and loads nothing from third parties. The site remembers the language you pick in your own browser only, and nothing is sent to us.

Transfers outside the EU

Apple, Google, GitHub and Web3Forms may process data outside the European Economic Area. They rely on safeguards recognised under the GDPR, such as the European Commission's standard contractual clauses.

Your rights

You can ask to access, correct, delete or export your data, including your multiplayer profile, to restrict or object to how it is used, and to withdraw consent at any time. Just email contact49game@icloud.com. You also have the right to complain to a data protection authority. In Poland that is the President of the Personal Data Protection Office (UODO).

Changes

If this policy changes, we will update this page and the date above.
